Terms & Conditions — Fishing Calendar

Applies to: the Fishing Calendar & Tide Times mobile application for iOS, iPadOS, watchOS and Android (the "App").

These Terms & Conditions ("Terms") are a legal agreement between you and TOP APP d.o.o., registered at Špruha 19, 1236 Trzin, Slovenia (VAT: SI41696093) — the developer and operator of Fishing Calendar ("Fishing Calendar", "the App", "we", "us", "our").

These Terms, together with the Fishing Calendar Privacy Policy and any store-level licence agreement, form the entire agreement between you and us regarding the App.

1. Definitions

• "App" — the Fishing Calendar & Tide Times mobile and wearable applications, and all associated features and content.
• "User" — anyone who uses the App, whether or not they hold an account.
• "Member" — a User who has registered an account.
• "User Content" — anything you submit, post or upload: catch photos, catch data, posts, comments, direct messages, profile details, reports and location tags.
• "Our Content" — all text, graphics, data, forecasts, software and other material we make available through the App.
• "Community" — the social features of the App: the feed, posts, comments, likes, chat and direct messages.

2. Eligibility and your account

• You must be at least 16 years old (or the minimum age of digital consent in your country, if higher) to create an account or use the Community.
• You must provide accurate registration information and keep it up to date.
• You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at info@fishingcalendarapp.com if you suspect unauthorised access.
• You may not use another person's account, impersonate any person or entity, or create an account on behalf of someone else without authorisation.
• One account per person. Accounts are personal and may not be sold, shared or transferred.
• You may delete your account at any time from Profile → Settings → Account → Delete Account, or by emailing info@fishingcalendarapp.com.

3. Licence to use the App

Subject to your compliance with these Terms, TOP APP d.o.o. grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the App on devices you own or control, for your own non-commercial use.

The App is licensed, not sold. We retain all right, title and interest in it. You may not:

• copy, resell, rent, lease, sublicense or otherwise redistribute the App or any part of it;
• reverse engineer, decompile, disassemble or attempt to derive the source code, except where this is expressly permitted by mandatory applicable law;
• modify or create derivative works of the App;
• remove or alter any copyright, trademark or other proprietary notices;
• scrape, harvest or bulk-extract data, forecasts or User Content from the App, or access it through automated means, without our prior written permission;
• circumvent any access control, rate limit, security measure or paywall.

We may update, change or discontinue features at any time. We aim to give notice of significant changes but are not obliged to maintain any particular feature indefinitely.

4. Forecasts, tides and weather — accuracy

The App provides solunar predictions, efficiency scores, tide tables, weather and other environmental data drawn from astronomical models and third-party data providers.

Predictions are estimates. Actual conditions, fish activity and tide levels vary with local geography, weather systems and factors outside our control. We do not guarantee the accuracy, completeness, timeliness or availability of any forecast or third-party data.

5. Fish Library

The Fish Library section of the App provides species profiles, including common and scientific names, habitat, and conservation status, for reference purposes.

This content is generated with the assistance of AI tools based on publicly available and scientific data sources. While we aim for accuracy, AI-generated content may contain errors, omissions, or outdated information. Before making decisions based on this content — including decisions about catching, keeping, or releasing a species, or compliance with local fishing regulations — please verify the information with your local fisheries authority or another qualified source.

6. Fish Identifier

Our Fish Identifier feature lets you take or upload a photo of a fish to receive an AI-generated species identification suggestion.

See the Fishing Calendar Privacy Policy for how photos submitted to this feature are processed. When you use Fish Identifier you confirm that you have the right to submit the photo and that it does not include other people without their consent.

We may limit the number of identifications available per user or per period, and may suspend the feature for maintenance or where a third-party AI provider is unavailable.

7. Community rules and conduct

The App includes a Community feature where users can share catches, comment, chat, and exchange tips with fellow anglers. By using these features, you agree to follow the rules below. Violations may result in the removal of content or in the restriction or termination of your access to the Community. We reserve the right, but have no obligation, to monitor, review, edit, or remove User Content at our sole discretion, at any time, and without notice or liability to you.

7.1 What you can post

You are welcome to share:

• Photos of your catches
• Comments on other users' posts
• Fishing tips and advice
• Location-tagged fishing reports
• Direct messages to other members

Please note that all public posts and profile information (display name, profile photo, and bio) are visible to other users.

7.2 What you must not post

To keep the Community safe and valuable, the following content is prohibited:

1. Disrespectful or harmful content. No harassment, threats, hate speech, or personal attacks. Do not target individuals or groups based on race, gender, religion, nationality, sexual orientation, age, or ability.
2. Fake or misleading content. Do not post content that is not your own or misrepresents reality. This includes AI-generated images presented as real catches, false catch details, or impersonation of others.
3. Illegal fishing activity. Do not share or promote illegal practices such as poaching, out-of-season catches, undersized or over-limit fish, fishing in restricted areas, or use of banned equipment. Always follow local fishing laws.
4. Content harmful to fish populations. Avoid posting content involving protected, threatened, or endangered species. Promote ethical fishing practices, including catch-and-release where appropriate.
5. Spam and unauthorised promotion. No repetitive posting, unsolicited ads, scams, or promotion of external services or competing products without written approval.
6. Inappropriate content. No nudity, sexual content, graphic violence beyond normal fishing context, or content involving minors in unsafe situations.
7. Privacy violations. Do not share others' personal information or content without consent. This includes photos of others, private messages, and exact locations of sensitive or restricted fishing spots.
8. Off-topic content. Posts must be relevant to fishing or related outdoor activities.

7.3 Our role

Fishing Calendar acts solely as a platform for users to share content. We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any User Content. You understand that by using the Community, you may be exposed to content that might be offensive, harmful, inaccurate, or otherwise inappropriate. Fishing Calendar is not liable for any User Content or for any loss or damage resulting from it.

8. Your content and the licence you grant us

You retain ownership of your content. By posting, you grant Fishing Calendar a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for formatting and display), and display your content within the App and its related services, for the purpose of operating and providing the App.

This licence ends when:

• you delete the content, or
• you delete your account.

Exceptions apply where the content has already been shared, re-posted or quoted by others, and to copies retained in backups for the period described in the Privacy Policy.

You represent and warrant that you own or have the necessary rights to all content you post, and that it does not infringe any third party's rights or violate any law.

8.1 Deleting your content

• You can delete your posts or comments at any time.
• Deleting your account removes your public content and profile from the Community.
• Some data may be temporarily retained in backup systems, as outlined in the Privacy Policy.

8.2 Feedback

If you send us suggestions, feature ideas or feedback, you grant us the right to use them without restriction or compensation. We are under no obligation to keep feedback confidential.

9. Moderation, reporting and enforcement

If you encounter content that violates these rules or infringes on your intellectual property rights, please report it using the in-app reporting feature, or contact us at info@fishingcalendarapp.com. You can also block any user directly from their profile or from any of their posts.

We review every report and act on objectionable content within 24 hours — by removing the content and, where warranted, ejecting the user who posted it.

We may, at our discretion and proportionately to the severity and frequency of the violation: remove or restrict content, issue a warning, temporarily restrict Community access, or permanently terminate an account. Where required by applicable law, including the EU Digital Services Act, we will inform you of the reason for a decision affecting your content or account and of the means available to contest it. To appeal a moderation decision, email info@fishingcalendarapp.com within 30 days.

Copyright complaints. If you believe content in the App infringes your copyright, send us a notice at info@fishingcalendarapp.com identifying the work, the location of the infringing content, your contact details, and a statement that you have a good-faith belief the use is unauthorised. We will act on valid notices and may terminate the accounts of repeat infringers.

10. Subscriptions, payments and renewals

The App is free to download. Some features require a paid subscription or one-time in-app purchase.

• Processing. All payments are processed by the Apple App Store or Google Play, according to their terms. We do not receive or store your payment card details.
• Auto-renewal. Unless stated otherwise at the point of purchase, subscriptions renew automatically at the end of each period at the then-current price, and are charged to your Apple or Google account within 24 hours before the end of the current period.
• Managing your subscription. You can turn off auto-renewal at any time in your Apple ID or Google Play account settings. Deleting the App does not cancel a subscription.
• Free trials. Where a free trial is offered, it converts into a paid subscription unless cancelled at least 24 hours before it ends. Unused trial time is forfeited when you purchase a subscription.
• Price changes. We may change prices. Changes to an existing subscription take effect only from the next renewal, and you will be notified in advance in accordance with the applicable store's rules, with the opportunity to cancel.
• Taxes. Prices may vary by country. For EU customers, VAT is charged according to your country of residence in line with EU VAT rules.

11. Cancellation and refunds

Refunds for purchases made through the Apple App Store or Google Play are handled by Apple or Google under their respective policies. We cannot issue refunds for purchases we did not process; please contact the relevant store directly.

EU/EEA and UK consumers — right of withdrawal. You normally have 14 days to withdraw from a distance contract for digital content. By purchasing and immediately accessing digital content, you request that we begin performance right away and acknowledge that you thereby lose your right of withdrawal once the content has been supplied in full. Statutory rights that cannot be waived are unaffected.

12. Acceptable use

In addition to the Community rules, you agree not to:

• use the App for any unlawful purpose or in breach of any applicable local, national or international law;
• upload viruses, malware, or any code intended to disrupt or damage the App or other users' devices;
• interfere with, overload, or attempt to gain unauthorised access to the App, its servers or connected networks;
• use bots, scripts or automation to create accounts, post content, or extract data;
• collect or store personal data about other users without their consent;
• use the App to develop, train or benchmark a competing product or machine learning model.

13. Intellectual property

The App, our forecasts and scoring methodology, the Fish Library, all software, designs, graphics, text and the "Fishing Calendar" and "TOP APP" names and logos are owned by TOP APP d.o.o. or its licensors and are protected by copyright, trademark and other intellectual property laws.

Nothing in these Terms grants you any right or licence to use our trademarks without our prior written permission. Copying, redistributing, publishing or commercially exploiting any part of the App is prohibited except as expressly allowed here. All rights not expressly granted are reserved.

14. Third-party services

The App integrates third-party services, including weather and tide data providers, AI processing providers, cloud hosting, analytics and social sign-in providers. We do not control them, do not endorse them, and are not responsible for their content, availability, accuracy, terms or privacy practices. Your use of any third-party service reached through the App is at your own risk and subject to that provider's own terms.

15. Apple and Google terms

These Terms are between you and TOP APP d.o.o. only, and not with Apple Inc. or Google LLC.

• Apple and Google have no obligation whatsoever to furnish any maintenance or support services in relation to the App. All maintenance and support questions should be directed to us at info@fishingcalendarapp.com, not to Apple or Google.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Apple and Google are not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• In the event of a third-party claim that the App infringes intellectual property rights, TOP APP d.o.o., not Apple or Google, is solely responsible for the investigation, defence, settlement and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple Inc. and Google LLC are third-party beneficiaries of these Terms and, upon your acceptance, have the right (and are deemed to have accepted the right) to enforce them against you.

16. Assumption of risk

Fishing involves inherent outdoor risks. Any locations, tips, or advice shared by users are followed at your own risk. Fishing Calendar is not responsible or liable for any personal injury, property damage, or legal consequences resulting from your real-world activities based on information found within the Community, the Fish Library, the Fish Identifier, or any forecast provided by the App.

You are solely responsible for holding any required fishing licences or permits, for knowing and complying with all local fishing regulations, seasons, size and bag limits, protected species rules and access restrictions, and for assessing weather, water and safety conditions before and during any trip.

17. Warranty disclaimer

Your use of the App or any content is at your own risk. YOU UNDERSTAND AND AGREE THAT THE APP IS PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULL EXTENT PERMITTED BY LAW, TOP APP d.o.o. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TOP APP d.o.o. MAKES NO REPRESENTATION OR WARRANTY THAT THE APP WILL (a) BE TIMELY, UNINTERRUPTED OR ERROR-FREE, OR OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, SOFTWARE, SYSTEM OR DATA; (b) MEET YOUR REQUIREMENTS OR EXPECTATIONS; (c) BE FREE FROM ERRORS OR THAT DEFECTS WILL BE CORRECTED; (d) PRODUCE ACCURATE FORECASTS, TIDE DATA, OR SPECIES IDENTIFICATIONS; OR (e) BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Nothing in these Terms excludes or limits any statutory consumer rights that cannot lawfully be excluded, including mandatory consumer guarantees under EU and Slovenian consumer law.

18. Limitation of liability

To the maximum extent permitted by applicable law, TOP APP d.o.o. shall not be liable for: (a) any indirect, incidental, exemplary, punitive or consequential damages of any kind; (b) loss of profits, revenue, data, use, goodwill or other intangible losses; (c) damages relating to your access to, use of, or inability to access or use the App; (d) damages relating to the conduct or content of any third party or other user, including defamatory, offensive or illegal conduct or content; (e) damages arising from reliance on any forecast, tide table, Fish Library entry or Fish Identifier result; or (f) damages in any manner relating to any content.

This limitation applies to all claims, whether based on warranty, contract, tort or any other legal theory, whether or not we have been advised of the possibility of such damage, and even where a remedy is found to have failed its essential purpose.

Where liability cannot be excluded, our total aggregate liability arising out of or relating to the App is limited to the greater of (i) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (ii) EUR 50.

Nothing here excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

19. Indemnity

By posting content and using the App, you agree to indemnify, defend and hold harmless TOP APP d.o.o., Fishing Calendar and their officers, agents, employees and team from any claims, damages, liabilities, costs or expenses (including reasonable legal fees) arising out of or related to the content you post, your use of the App, your violation of these Terms or the Community Rules, or your violation of any law or the rights of a third party.

20. Suspension and termination

We reserve the right to suspend or terminate your access to all or part of the App, with or without notice, where you breach these Terms, where we reasonably suspect fraudulent, abusive or illegal activity, or where required by law. Suspected illegal activity may be referred to the appropriate authorities.

Upon termination or suspension, your right to use the App ceases immediately, and we may deactivate or delete your account and associated content. We will not be liable to you or any third party for any claim or damage arising out of a termination or suspension carried out in accordance with these Terms.

You may terminate at any time by deleting your account. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnity and governing law — will survive.

21. Changes to these Terms

We may amend these Terms from time to time. The current version is always published on this page with the "Last updated" date at the top. Where changes are material, we will give reasonable advance notice in the App or by email before they take effect. Your continued use of the App after the effective date constitutes acceptance. If you do not accept the revised Terms, you must stop using the App and may delete your account.

22. Governing law and disputes

These Terms are governed by the laws of the Republic of Slovenia, without regard to conflict of law principles. The courts of Ljubljana, Slovenia have exclusive jurisdiction over any dispute arising from them.

If you are a consumer resident in the EU/EEA, you retain the protection of the mandatory consumer laws of your country of residence and may bring proceedings in your local courts. EU consumers may also use the European Commission's Online Dispute Resolution platform.

23. General

• Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
• Severability. If any provision is found unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be applied to the maximum extent permitted.
• No waiver. Our failure to enforce any provision is not a waiver of that provision or of the right to enforce it later.
• Assignment. You may not assign or transfer your rights under these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
• Force majeure. We are not liable for failure to perform caused by events beyond our reasonable control, including outages of third-party data providers, network failures, natural events or acts of government.
• Language. These Terms are drafted in English. Any translation is provided for convenience; the English version prevails.
