• “We”, “Us”, “Our” — refers to Fishing Calendar App, operated by Top App d.o.o., the owner of the Service.
• “Visitor” — someone who browses our Service but has not registered as a Member.
• “Member” — an individual who has registered with us to use our Service.
• “User” — a collective identifier referring to either a Visitor or a Member.
• “Service” — the collective functionality and features offered through our applications and website.
• “Content” — all text, information, graphics, audio, video, and data offered through our Service.

Fishing Calendar App makes no representations or warranties that the use of the Services will: (a) be timely, uninterrupted or error-free; (b) meet your requirements or expectations; (c) be free from errors or that defects will be corrected; or (d) be free of viruses or other harmful components.

You agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of our Service. Fishing Calendar App reserves the right to investigate complaints or reported violations of our Legal Terms and to take any action we deem appropriate, including cancelling your Member account, reporting suspected unlawful activity to law enforcement authorities, or disclosing any information necessary relating to your profile, email addresses, usage history, posted materials, IP addresses and traffic information, as permitted under our Privacy Policy.

To the maximum extent permitted by applicable law, Fishing Calendar App shall not be liable for:

• Any indirect, incidental, exemplary, punitive, or consequential damages of any kind;
• Loss of profits, revenue, data, goodwill, or other intangible losses;
• Damages relating to your access to, use of, or inability to access or use the Services;
• Damages relating to any conduct or content of any third party using the Services, including defamatory, offensive, or illegal conduct or content; and/or
• Damages in any manner relating to any Content.

This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory, whether or not Fishing Calendar App has been informed of the possibility of such damage.

Our Service may contain trademarks of Fishing Calendar App, our affiliates, or other companies. Your use of our Service does not grant you any right or licence to use such trademarks without prior written permission from the corresponding trademark owner.

Our Service is also protected under international copyright laws. Copying, redistribution, use, or publication of any portion of our Service is strictly prohibited. Your use of our Service does not grant you ownership rights of any kind.

Fishing Calendar App grants you a royalty-free, non-exclusive, worldwide, non-transferable licence to access and use the Service for the applicable subscription term, subject to these Terms. Fishing Calendar App is not transferring ownership or title to the Service to you.

You acknowledge that the Services and their related software are proprietary to Fishing Calendar App and/or its suppliers and are protected by copyrights, trademarks, service marks, patents and/or other proprietary rights. You may not:

• Remove any proprietary notices or labels from the Services.
• Alter, modify, redistribute, sell, decompile, reverse engineer, or disassemble the Services.
• Reproduce, distribute, or create derivative works without express written authorisation.
• Rent, lease, grant a security interest in, or otherwise transfer any rights to the Services.

When using the Services you agree to:

• Comply with all applicable laws and regulations;
• Not use the Service to distribute viruses, malware, or other harmful components;
• Not use the Service for any illegal purposes;
• Not delete legal notices or modify logos you do not own;
• Not use the Service to interfere with other networks or infringe any third party’s intellectual property rights;
• Not distribute unlawful, harassing, defamatory, racist, violent, threatening, or obscene material.

You are solely responsible for your account and any transmissions made when using the Services. You shall not access someone else’s account without prior permission of the account holder.

Payment of Subscriptions

Payment of the subscription fee is upfront for the selected period and must be made by credit card, PayPal®, or Apple App Store. All payments are processed by Braintree, PayPal, or Apple App Store.

Free Subscriptions

Subscriptions to any of Fishing Calendar App’s free Services do not require a subscription fee. Fishing Calendar App reserves the right to restrict or limit the number of free versions that may be used by any individual or entity.

EU Customers

The price for the service may vary in accordance with EU VAT regulations. VAT is declared based on your residency, and the price is calculated after you provide proper residency information.

No Cancellations

You may not cancel, terminate, or rescind a subscription during its term. All payments to Fishing Calendar App for access to the Services are final.

Paying via PayPal®

When you select PayPal to make payments, the transaction is redirected to PayPal’s payment site. Your financial information is not shared with Fishing Calendar App when PayPal is used. Your PayPal account is subject to PayPal’s own terms and privacy policy.

Taxes

You are responsible for any applicable sales, VAT, excise, or other taxes relating to this licence or your use of the Service. If you are exempt from such taxes, you must provide appropriate evidence of tax exemption for all relevant jurisdictions.

Promotions & Discounts

Sales, promotions, and special discounted pricing offers are temporary and may expire upon subscription renewal. Fishing Calendar App reserves the right to discontinue or modify any coupons, credits, or promotional offers at its sole discretion.

Our Service may contain links to third-party websites. These links are provided solely as a convenience to you. By linking to these websites, we do not create or have an affiliation with, or sponsor, such third-party websites. The inclusion of links within our Service does not constitute any endorsement, guarantee, warranty, or recommendation of such websites.

Fishing Calendar App has no control over the legal documents and privacy practices of third-party websites; as such, you access any such third-party websites at your own risk.

Our Legal Terms shall be treated as though executed and performed in Slovenia, and shall be governed by and construed in accordance with the laws of Slovenia, without regard to conflict of law principles. You agree to submit to the personal jurisdiction and venue of such courts.

Our failure to enforce any provision of our Legal Terms shall not be deemed a waiver of such provision nor of the right to enforce such provision. The rights of Fishing Calendar App under our Legal Terms shall survive the termination of our Legal Terms.

Fishing Calendar App reserves the right to terminate or suspend your access to all or part of the Services with or without notice and for any reason, including breach of this Agreement. Any suspected fraudulent, abusive, or illegal activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities.

Upon termination or suspension, your right to use the Services immediately ceases. We may immediately deactivate or delete your account and all related information and files. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension.

You will indemnify and hold us (and our officers, agents, and employees) harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.

Google and Apple have no obligation to provide any support or maintenance services in relation to our Android or iOS applications. If you have any maintenance or support questions, please contact Fishing Calendar App directly using the contact details at the end of these Terms — not Google or Apple.

Fishing Calendar App includes a Community feature where users can share catches, comment, chat, and exchange tips with fellow anglers. By using these features, you agree to the rules below. Violations may result in content removal or restriction/termination of your access.

• Photos of your catches
• Comments on other users’ posts
• Fishing tips and advice
• Location-tagged fishing reports
• Direct messages to other members

All public posts and profile information (display name, profile photo, and bio) are visible to other users.

🚫 What You Must Not Post

1. RESPECT No harassment, threats, hate speech, or personal attacks based on race, gender, religion, nationality, sexual orientation, age, or ability.
2. AUTHENTICITY No fake or misleading content, including AI-generated images presented as real catches, false catch details, or impersonation.
3. LEGAL Do not share or promote illegal fishing practices — poaching, out-of-season catches, undersized/over-limit fish, fishing in restricted areas, or use of banned equipment.
4. CONSERVATION Avoid content involving protected, threatened, or endangered species. Promote ethical fishing, including catch-and-release where appropriate.
5. SPAM No repetitive posting, unsolicited ads, scams, or promotion of external services without written approval.
6. CONTENT No nudity, sexual content, graphic violence beyond normal fishing context, or content involving minors in unsafe situations.
7. PRIVACY Do not share others’ personal information or content without consent — including photos, private messages, or exact locations of sensitive fishing spots.
8. ON-TOPIC Posts must be relevant to fishing or related outdoor activities.

Your Content, Your Rights

You retain ownership of your content. By posting, you grant Fishing Calendar App a licence to use your content within the app for operational purposes. This licence ends when you delete the content or your account, except where content has already been shared by others.

Deleting Your Content

You can delete your posts or comments at any time. Deleting your account removes your public content and profile from the Community. Some data may be temporarily retained in backup systems as outlined in our Privacy Policy.

Legal Disclaimers & Liability

Indemnification: By posting content, you agree to indemnify and hold harmless Fishing Calendar App and its team from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your content or violation of these Community Rules.

Assumption of Risk: Fishing involves inherent outdoor risks. Any locations, tips, or advice shared by users are followed at your own risk. Fishing Calendar App is not responsible for any personal injury, property damage, or legal consequences resulting from real-world activities based on Community content.
